Would you agree that drug testing welfare applicants unconstitutional?
In Michigan, the judge ruled that drug testing new welfare applicants as unconstitutional. Do you agree with this? Give reasons for your opinion:

For everyones understanding, it is not me that is using drugs. I am actually from Indiana. I just think that the judge should have ruled in the favor of allowing drug testing to be done.

It might be a denial of equal protection under the law because other types of welfare recipients are not subject to such tests. For example, the millions of people who live in subsidized housing because they claim the mortgage interest deduction on their tax return are not subject to the same rules and there is no rational basis for testing some recipients while letting the others get their subsidy without interference.

No I do not think it is unconstitutional because that is money from the public that is being given to welfare applicants. The government should not allow any that is on welfare to possibly be on drugs. They could possibly be using the welfare money to purchase drugs. I have also seen it happen in southern california. I do not use drugs to clarify and am not on welfare.

This is all my opinion, and I have no facts or statistics for it.
I think they should be drug tested and denied welfare if they test positive. I don’t see anywhere in the Constitution where it gives an individual the right to use illegal drugs.
And if they have children and test positive for drugs, they should be considered an unfit parent and their child(ren) placed in foster care.

I believe that if you are asking the state to be involved in your life, you do not then have the right to determine how involved they are. You can’t ask the state to put a roof over your head and food in your stomach and then say “Oh now you want to restrict me from doing certain things? That’s beyond your power”. If you want the government out of your life, do not invited them in. And quite frankly, if my tax dollars are going to someone, I don’t want them spending it on drugs.

Hell no ! If working individuals have to piss in a cup, then so should the free cheese eaters. It is common for people on welfare to be drug dealers & users too. (not all of them)
