Question : Can I get legal action for discrimination for bariatric surgery?
My friend had signed up for bariatric surgery and they rejected her because she “ate too much” and because “diets failed”. I believe most diets don’t really work, and that those clinic who agreed to help her was supposed to help her find support in the diet areas.Refer her to support groups who could help her stay the course. My friend lives in
ekin Illinois and wants to know if she can get legal advise to deal with this clinics unfair discrimination . Where could we get help legal wise?

what, you think you can legally force a doctor to perform surgery that is not indicated? best she gets psychiatric help. sounds like she has a serious eating disorder.

It’s not discrimination. Bariatric surgery is risky and is not a guarantee for permanent weight loss. For the best results, the patient must be able to lose some weight before surgery (for safety reasons), and must be able to control their eating after surgery. There are quite a few bariatric surgery patients who will lose weight at first, but after a while will start to overeat anyway (despite the pain and vomiting) and start to gain a lot of weight. The clinic probably should have referred her to other options that would work out better with her situation, but this isn’t grounds for a lawsuit.

I personally know of two deaths as a result of the surgery. This is not just cosmetic and a patient has to be willing to take the risk. Often, then, it is a last result. It sound as though you friend is not a good candidate for the surgery. Look at it this way, it has be the opinion of the clinics that she would not survive the surgery. Do you still think that is discrimination to chose her life over probable death? Both of you need to re-think this.
