I refused the breathalyzer but received a “possession of alcohol ticket. What they have on me?
Leaving College have a party (on foot) until I was taken by police for possession of alcohol, even though I didn’t everything to me. I have nothing to confess and she refused the Breathalyzer. The officer gave me a ticket and court date. Do they have anything on me? Thanks for all the helpful answers! The only reason why I was refused the test, because while walking back to my seat, he drove up to me and said he suspected that I was at the party. And it does not have any slideshow seems to me that the suspect might be enough for everything.

Since you were walking I doubt that implied consent comes into play, I believe that implied consent applies for suspected DUI or DUAI only (driving offenses). I could be wrong, but I doubt it.
What could the officer have on you? You were in the area of a party where underage drinkers were being served. Walking (maybe a little unsteady on your feet), and probably had the smell of alcohol on your breath.
The officer will testify as to what he observed before he ticketed you. Nobody knows if that testimony will be enough to convict you.

Possession of Alcohol, so where is the evidence to be presented to the judge.
Ticket said he thought you were under influence? So has to prove other then a word like, Breathalyzer, sobriety field test,?
Many people have been arrested and had bad breath only, why a field test is usually done by me on a PUI as well as a DUI.
Tell em you had been drinking funny beer (Smells, tastes, looks like beer but no alcohol.) -

the officer can really only bring up that you looked intoxicated, refusing to take a breathalyzer isn’t complying with the law, that might be in favor of the police officer.
Most likely however if you attend the court date you should have nothing to worry about.
In my experience officers don`t even show up to minor offensives and don`t bother showing up, leaveing you in the clear.Good luck Buddy, hope this helps

Maybe public drunkenness? Are you underaged? Were there underaged people at the party? Those are game changers. I learned in criminology class that if a cop stops you then you are essentially under arrest. So not complying– idk– things get complicated with law sometimes.
