@SharMess I know that your denial was in 2005, you have stated that before. I am more interested in when you filed it and whether it was before or after this case was settled.
I question the case further because looking at Homer’s site he does not mention that case even though it would be a big win, and further there is a second case he does mention (Althen) which makes no mention of the Rogers case even though it would have served as a precedent. -

@batigol47 I was led to believe it had been settled. I filed in 2001.
I went to many concerts in the 70′s & 80′s. I saw ELP twice – ’72 & ’73 & was fortunate to be invited back stage both times (I’ve got photos!). I was inspired to learn From the Beginning and performed it numerous times. Years later I formed a rock band, played lead guitar and sang the lead. You can’t tell from the vid’s I’ve uploaded, but I am rocker – 1st. Saw the Beatles in ’66 at Dodger Stadium at age 11!.

@batigol47 DHHS contacted me via mail and when I phoned them to find out what the mailing was all about they referred me to Ron Homer. I new nothing about VICP prior to DHHS contacting me.
StumpyOuch asked why I filed without doctors’ help. I had MANY family members, husband, friends, all my band mates, one of whom was a professor at UW in Seattle in neuro science and has a brother with MS, all told me to file. All witnessed the results after the tetanus shot. What was there to lose?

@SharMess I do not speak for my wife, but I would not go as far as to tell someone not to file out of hand. However, without the backing of a doctor for an off table injury it is futile from the outset and I question motives for any lawyer who specializes solely in these cases (like Homer) pursuing it. Moreover, it is not theorizing and asking for an arbitration I take issue with, but rather the refusal to accept the decision when the weight of scientific evidence points in another direction.

Reasons for filing VICP:
6 months after the VAERS was filed, I was contacted by a research company pursuant to the tetanus shot. The researcher would not identify herself or her firm and asked very politely for my information regarding the tetanus shot. She said her company was hired by the CDC to collect the info and I had no problem with answering any of her questions. Following her questions, we had a chat.

@batigol47 The chat with the researcher, who was “tracking trends” consisted of my complaints and suspicions about the onset of my symptoms immediately after the tetanus shot. The researcher told me that she was seeing a lot of this happening and that I was on the right track even though I had been told it was impossible. She said, it’s obviously not impossible, because she was seeing more and more of it as she “tracked the trends”. She told me not to let anyone tell me otherwise.

After my discussion with the researcher, I was still 2 1/2 years away from filing the VICP claim.
I could still walk, though with great difficulty and began using a cane the following year. My eye sight began deteriorating significantly and within 6 months of the tetanus shot I needed glasses. It took years to get to the state I am now.I began seeing another neuro, who had great sympathy for what I’d been through with the neglect of the care of my dr’s.

@batigol47 The neuro let me tell my story and he questioned the reason for the tetanus shot. He said it was a questionable decision by the GP and he would never have supported the decision to give a “routine tetanus shot”.
I felt hurt, and angry at the system we have in place that would harm someone who had a life, was running a business AND paying taxes. I saw how badly, our health care system was out of control and needed an overhaul.
And I vowed to be a loud voice for as long as I live

From my perspective, there was NEVER a question as to what happened, nor my ex-husband’s, nor my mother’s, or any of my close friends. I was one way one day, then growing more and more disabled after the tetanus shot.
I KNOW what happened.
VICP offered a list of 6 attorneys, but only Ron Homer and another were still taking vaccine cases. The other was going on vacation. I had a lengthy conversation with Ron Homer who handed me off the Sylvia Chin-Caplan

@batigol47 My attorney, Sylvia, told me to try and find a doctor to support me, because it would be difficult to prove without one. Though YOU have insinuated that I shop for doctors, I have not done this.
I already had a neuro that I was happy with. He had understanding, but he did not see me prior to the shot, so I did not feel comfortable asking him if he would want to be part of my case. He did not have direct knowledge, only my say so, And I wasn’t about to “look” for another.

@batigol47 I consulted with my loved ones and several close friends regarding the filing and all agreed with me, that it needed to be done. These were all people who provided affidavits.
I had reality on my side, not fuzzy, profit and political driven science.
Sylvia told me about the Helen D Rodgers case and sent me transcripts of the decision.
I didn’t provide a doctor to back up my claim, so I they just went with their old stand by, Vera Byers.

@batigol47 Sylvia told me she felt very good about the direction the case was headed after the 2nd hearing.
I did not like much of what I heard and wanted to scream during the teleconference. I was not happy that Sylvia let the “theory bit” go unchallenged, when there was absolutely no proof or evidence to support it.
I guess what ultimately happened is that my attorneys just cut and ran. They made their $15K off the case. I get to be disabled and get on with my life as best I can.

Dear bag,
I BELIEVE much of it is junk science, being conducted by biased interests. Big Pharma fox guarding the hen house. If my original 2 doctors (GP and neuro who ran like hell from me) involved in my case are indicative of the kind of people in this science, our health care system is doomed. Or should I say we, the potential victims, are doomed.

@batigol47 In my former business I worked with a diverse portion of the population, MANY were nurses. Most of them said they had seen reactions of the kind I describe and were saddened, but not surprised when I told them how my own doctors turned their backs on me.
They said doctors don’t like to admit when this kind of thing happens, because it is their job to keep giving these shots, but it does happen.
I just went along with what my original doctors said.

@batigol47 I went along with what my 2 original doctors said (that it was a coincidence and I quit pestering them. They weren’t going to help me and I thought there was no help even thought I KNEW I was right.
VICP gave me a voice! I didn’t prevail, though I know if I’d had a doctor behind me there’s no question I would have. It was a big factor in the judge’s decision.
It is what it is and that’s why I post on Youtube. Mine is a cautionary tale.
Caveat Emptor. Vaxes can harm.

I have MS and it didn’t need to be made worse so soon. Why do my doctors think I shouldn’t receive another vaccination if there is not some sense that the tetanus shot was responsible for my sudden and rapid decline in 1999?They also question the studies you so often refer to. I take my information from Dr Mercola and the other fine doctors who know of studies debunking the science you speak of. Trash them all you like, but it will not change my hard won opinion.

Less than 1% of women chronically infected with HPV get cancer. That’s not cause & effect. That’s mere coincidence of a common infection & a rare cancer
There is no proof HPV causes cancer, only epidemiological associations of 76% to 93%. HPV oncogenicity is assumed & hypothesis constructed to explain. That’s not scientific method -

Gardasil is a complete waste of time and money
All types of HPV are very slow acting virus. According to the FDA/CDC over 90% of us get rid of it naturally with our immune systems. That includes getting rid of warts and skin or cervical changes
Those of us that don’t get rid of HPV naturally have immune system problems caused by nutrition deficiencies, toxins or genetics
Vaccines passively rely on a working immune system and should never be used for slow acting infections like HPV

@batigol47 The court was unconvinced by Dr. Arnason’s arguments to the contrary. At hearing, Dr. Arnason displayed a cavalier and condescending attitude when questionsed about this issue. He relied on his past achievements, addressed Petitioner’s evidence lightly in passing, and appeared less knowledgeable of recent research data referenced by his opponents.
